Terms of Use and Sale

1. Provider, purpose, and acceptance

Captain Transcribe is operated by Ayoub KHAMASSI, whose full identity appears in the Legal Notice. The service converts audio or video files into text and TXT, SRT, or VTT subtitles.

Using the service means accepting these terms. For a purchase, acceptance is collected in Stripe Checkout before the order is submitted.

2. Trial, account, and legal capacity

A no-account trial may process one file of no more than 5 MB and 3 minutes, subject to anti-abuse controls. Saved features require an account.

You must have legal capacity to enter into a contract. You are responsible for accurate account information, keeping credentials confidential, and activity through your account or API keys.

3. Plans, quotas, and storage

The features, price, currency, taxes, and limits shown on the Pricing page and summarized in Stripe Checkout at the time of purchase apply. If they differ, the accepted order summary controls.

  • Free: 10 included minutes per cycle and 30-day transcription storage.
  • Starter: 120 included minutes per month and 90-day storage.
  • Creator: 600 included minutes per month and 90-day storage.
  • Pro: 2,400 included minutes per month and storage until user deletion.
  • Included minutes renew each cycle and do not roll over. Purchased or awarded bonus minutes remain attached to the account until used or the account is deleted.

4. Subscriptions, payment, and cancellation

Paid subscriptions renew monthly until canceled. Stripe processes payments and provides available billing documents. The total price and applicable taxes are shown before confirmation.

You may schedule cancellation through the billing portal; it normally takes effect at the end of the paid period. Deleting the account instead immediately cancels the subscription and removes content.

Minute purchases are one-time transactions and do not start a subscription. Refunds and withdrawal rights are handled under mandatory applicable law; nothing in these terms restricts statutory consumer rights. Contact support promptly for an ordering error.

5. Content and permissions

You retain rights in files and results. You grant only the technical rights needed to temporarily host, send to transcription providers, process, store, and return the content.

You confirm that you have the rights, consents, and notices required to record, upload, and transcribe content, especially where third parties, sensitive data, confidential communications, or protected works are involved.

6. Acceptable use and security

You must not use the service for unlawful content, infringe third-party rights, distribute malware, evade quotas or controls, scrape the service abusively, share API keys, or disrupt infrastructure.

We may restrict or suspend access when needed for security, fraud prevention, legal compliance, or a material breach, with appropriate notice where circumstances allow.

7. Quality, availability, and backups

Speech recognition uses artificial intelligence, and accuracy varies with audio quality, language, accents, and overlapping speakers. Review output before important legal, medical, financial, or professional use.

We seek service continuity, but maintenance, incidents, or external providers may cause interruption. Export important content before its expiry date. Statutory warranties and liabilities that cannot lawfully be excluded remain unaffected.

8. Service intellectual property

The brand, interface, code, text, and graphics remain protected by intellectual-property law. No right in the service itself is transferred beyond the limited right to use it under these terms.

9. Personal data

The Privacy Policy explains processing, providers, transfers, retention, and individual rights. Media and results follow the plan retention period set when created and may be deleted earlier by the user.

10. Changes to terms and service

We may evolve the service and these terms. A material change affecting a current subscription will be announced through a durable medium or in the service with reasonable notice. A price increase does not apply retroactively to a period already paid.

11. Governing law and complaints

French law applies without depriving consumers of mandatory protections in their country of residence. First send complaints to khamassi1995@gmail.com.
